SwiftDeal Terms of Service

1. Platform Scope & Global Jurisdiction

SwiftDeal operates as a global technology platform connecting passengers with independent drivers worldwide. These Terms of Service are governed by international marketplace standards and applicable local regulations in each operating territory.

Users are responsible for complying with local transportation laws, licensing requirements, and regulations in their jurisdiction.

2. Nature of Service

SwiftDeal is NOT a transportation provider, taxi company, or carrier.

What SwiftDeal Provides:

• Technology platform for ride request connections
• Suggested fare calculations based on distance and time
• Communication facilitation between passengers and drivers
• Digital marketplace infrastructure

What SwiftDeal Does NOT Provide:

• Employment or hiring of drivers
• Vehicle ownership or operation
• Transportation services
• Agency representation for drivers or passengers
• Cash payment processing or handling

3. Independent Contractor Relationship

All drivers using SwiftDeal are independent contractors, not employees, partners, or agents of SwiftDeal.

4. Payment Terms - Cash Only

ALL RIDE FARES ARE PAID IN CASH DIRECTLY FROM PASSENGER TO DRIVER.

SwiftDeal's Role in Payments:

• Does NOT process any ride fare payments — passengers pay drivers directly in cash
• Does NOT handle or guarantee cash transactions between passengers and drivers
• Charges a 10% lead-generation commission on each completed ride, automatically deducted from the driver's prepaid SwiftDeal Wallet
• Provides suggested fares as advisory guidance only

The suggested fare displayed is calculated using the formula: Base + (Distance × Rate) + (Time × Rate) with JMD baseline rates converted to local currency. The actual payment amount is negotiated and agreed upon between the passenger and driver. SwiftDeal has no control over and is not responsible for the payment exchange.

5. Driver Prepaid Wallet & Commission

Drivers must maintain a positive balance in their SwiftDeal Wallet to receive and accept ride requests on the platform.

How the Wallet Works:

• Drivers top up their SwiftDeal Wallet by purchasing consumable "SwiftDeal Credits" via Google Play Billing (Android) or Apple In-App Purchases (iOS)
• The minimum top-up amount is $5.00 USD (or the equivalent in the driver's local currency, dynamically converted based on their detected location)
• When a driver completes a ride, SwiftDeal automatically deducts a 10% lead-generation commission from the driver's wallet balance
• The passenger pays the full ride fare directly to the driver in cash — the 10% commission is deducted from the driver's prepaid wallet, not from the cash fare
• If the driver's wallet balance drops to zero or below, they will be unable to go online or accept new ride requests until they top up

Commission Structure:

• Commission rate: 10% of the total ride fare on each completed trip
• The commission is a lead-generation fee for connecting drivers with passengers through the SwiftDeal platform
• Commission is calculated based on the agreed fare between passenger and driver, and is deducted automatically upon trip completion
• Drivers can view their full wallet transaction history (top-ups and deductions) within the app at any time

Wallet Credit Terms:

• SwiftDeal Wallet credits are non-refundable once purchased
• Wallet credits hold no cash value outside the SwiftDeal platform and cannot be exchanged for cash, transferred to another user, or redeemed in any other form
• Wallet credits are denominated in the driver's local currency and are used solely to pay platform commission fees
• SwiftDeal reserves the right to modify commission rates with 30 days' advance notice to active drivers
• In the event of account termination, any remaining wallet balance is forfeited

6. Limitation of Liability

SwiftDeal is NOT LIABLE for:

• Acts or omissions of drivers or passengers
• Quality, safety, or legality of transportation services
• Vehicle accidents, injuries, or property damage
• Driver background, credentials, or behavior
• Passenger conduct or payment disputes
• Cash transactions or fare disagreements
• Lost or stolen property
• Delays, cancellations, or no-shows
• Compliance with local transportation laws
• Insurance coverage or claims

7. Driver Requirements & Verification

Drivers Must:

• Upload required documents (vehicle photo, registration, government ID, selfie)
• Await admin approval before accessing platform features
• Maintain a positive wallet balance to receive ride requests
• Comply with local licensing and insurance requirements
• Maintain valid driver's license and vehicle registration
• Carry appropriate insurance (commercial/rideshare as required by law)

Important: SwiftDeal verifies uploaded documents for completeness but does NOT guarantee accuracy, authenticity, or legal compliance. Users should independently verify driver credentials before entering any vehicle.

8. Passenger Responsibilities

Passengers are responsible for:

• Verifying driver identity before entering vehicle
• Paying agreed fare in cash directly to driver
• Behaving lawfully and respectfully
• Understanding that SwiftDeal is not liable for the ride
• Their own safety and well-being during transportation

9. Global Currency & Pricing

SwiftDeal displays fares in local currency based on user's detected location.

Fare Calculation:

• Formula: Base + (Distance × Rate) + (Time × Rate)
• Baseline: JMD $250 base, $75/km, $10/minute
• Automatically converted to local currency using real-time exchange rates
• Suggested fare is advisory only
• Actual payment negotiated between passenger and driver

10. User Data & Privacy

SwiftDeal collects location data, ride details, and documents as described in our Privacy Policy. By using SwiftDeal, you consent to data collection and processing as outlined in our Privacy Policy.

11. Prohibited Activities

Users may NOT:

• Use SwiftDeal for illegal activities
• Harass, threaten, or harm other users
• Provide false information or fraudulent documents
• Attempt to defraud drivers or passengers
• Violate local transportation laws or regulations
• Circumvent wallet, commission, or verification requirements

12. Disclaimer of Warranties

SwiftDeal is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied.

We Do NOT Guarantee:

• Availability of drivers at any time or location
• Accuracy of fare estimates or calculations
• Safety or quality of rides provided by drivers
• Uninterrupted or error-free service
• Driver qualifications or fitness to provide transportation

13. Indemnification

Users agree to indemnify, defend, and hold harmless SwiftDeal, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of the platform
• Violation of these terms
• Transportation services provided or received
• Cash payment disputes or transactions
• Your violation of any law or regulation
• Your violation of any rights of another party

14. Termination

SwiftDeal reserves the right to suspend or terminate user accounts at any time, with or without notice, for:

• Violation of these terms
• Fraudulent activity or misrepresentation
• Safety concerns or complaints
• Legal compliance requirements
• Any other reason at SwiftDeal's sole discretion

15. Changes to Terms

SwiftDeal reserves the right to modify these terms at any time. We will provide notice of material changes by updating the "Last Updated" date. Continued use of the platform after changes constitutes acceptance of updated terms.

16. Governing Law & Dispute Resolution

These terms are governed by international marketplace standards. Any disputes will be resolved through binding arbitration in accordance with applicable arbitration rules. Users waive the right to participate in class-action lawsuits.
